TERMS AND CONDITIONS OF SALE

These Terms and Conditions govern the sale of goods through our e-shop Penguin Record Store (penguinrecordstore.eu). The seller is Michaela Ondračková, ID number (IČO) 10996028, VAT number (DIČ) CZ9056045944, with registered office at U Parku 3068/1a, Ostrava, Czech Republic, e-mail: info@penguinrecordstore.eu.

These Terms are part of the contract between us (the Seller) and you (the Buyer), which is concluded when purchasing goods online. The contract is concluded remotely – without physical presence – via our website interface.

In case of any conflict between these Terms and the information provided in your order, the information in the order shall prevail.

I. DEFINITIONS

You – the person purchasing on our e-shop, referred to as the Buyer.

We – the e-shop Penguin Record Store, i.e., the Seller.

Goods – anything you can purchase on our e-shop.

Price – the amount for the goods.

Shipping cost – the amount for delivery and packaging.

Total price – goods price + shipping.

Order – a proposal to purchase goods from us.

B-Stock – goods with minor cosmetic defects (e.g., damaged cover) that do not affect functionality; these defects are not subject to warranty claims.

II. GENERAL PROVISIONS AND INSTRUCTIONS

Purchase of goods is possible only via our e-shop.

Please ensure that all information provided when ordering is correct and truthful so that we can deliver your order without problems.

III. CONCLUSION OF THE CONTRACT

The contract with us can be concluded in Czech or English.

The contract is concluded remotely via the e-shop. Costs for using the internet or other remote communication tools are borne by you and do not differ from standard rates.

To conclude the contract, an order must be created on the e-shop. The order includes:
a) designation of the selected Goods (by clicking “Add to Cart”),
b) information about Price, Shipping cost, payment method, and delivery method,
c) your contact details (name, address, phone, e-mail).

After checking the details, send the order by clicking the button “Order binding for payment”. Before sending, you must confirm that you have read and agree to these Terms.

After sending the Order, you will automatically receive an e-mail confirming its receipt. This confirmation does not constitute the conclusion of the contract – it only summarizes the order.

The contract is concluded only when the order is paid.

In case of an obvious error in the Price (e.g., typo or missing digit), we are not obliged to supply the Goods at this price, even if you have already received confirmation of the order. In such case, we will contact you.

If you have a User Account, you may place orders through it. Even in this case, it is necessary to verify the accuracy of the information.

Discounts may be applied by entering a discount code during the order process.

Payment is made in the currency you select.

IV. USER ACCOUNT

By registering on our e-shop, you can create your User Account.

When registering, you must provide truthful and up-to-date information. If any information changes, please update it.

Access to the account is protected by a username and password. Please keep these details safe and do not share them with others. We are not responsible for misuse.

The User Account is personal – it cannot be provided or shared with others.

We may cancel your account if it is not used for more than 12 months or if you violate your obligations under these Terms.

The User Account may not be available continuously, e.g., due to system maintenance or technical issues.

V. PRICES, PAYMENT TERMS, AND RETENTION OF TITLE

The Price is always listed in the e-shop and in the Order proposal. Shipping cost and any conditions for free shipping are also indicated.

The Total Price includes VAT and all statutory fees.

Payment of the Total Price is required after concluding the Order and before delivery of the Goods. Payment can be made as follows:
a) Online by card – payment is processed via the Shoptet Pay gateway and is due immediately upon completion.
b) Bank transfer – in exceptional cases, we will provide payment details upon request.

The invoice will be issued after payment of the Total Price and sent by e-mail upon request.

Ownership of the Goods transfers to you only after payment of the Total Price and receipt of the Goods.

VI. DELIVERY OF GOODS, TRANSFER OF RISK

Goods are delivered via courier (Czech Post, PPL, DPD, Zásilkovna, etc.).

The Seller does not ship to forwarding (re-shipping) addresses.

If a forwarding address is detected, the order may be canceled. Paid amounts will be refunded, excluding non-refundable fees charged by the payment gateway.

If a forwarding address was not identified or hidden, the Seller is not responsible for loss, damage, or defects after the courier receives the parcel.

Goods in stock are handed to the carrier within 5 business days. Pre-orders are delivered according to supplier availability.

If your order contains pre-order items, partial shipment is not available. All items will be shipped together once everything is available. If you want in-stock items to be shipped separately, please place a separate order.

The Buyer must check the package upon receipt and report any defects immediately.

Risk passes to the Buyer upon receipt.

VII. RIGHTS IN CASE OF DEFECTIVE PERFORMANCE

The Seller guarantees that the Goods are free from defects and correspond to the description at the time of delivery.

Minor cosmetic defects in the packaging do not affect functionality and are not subject to claims.

For B-Stock Goods, listed defects are not subject to claims.

Claims and damaged goods

If the Goods are damaged during transport or have any other defect, the Buyer must report this immediately by e-mail to info@penguinrecordstore.eu, including photographic documentation.

The Seller and the Buyer will agree on an appropriate solution depending on the extent of the damage:

  • partial refund (the Buyer keeps the Goods), or

  • return of the Goods and full refund / replacement.

Return procedure:
a) For customers in the Czech Republic, Slovakia, and Hungary: the Seller will provide a prepaid return label.
b) For customers in other EU countries: the Seller will provide the address of a collection point to which the Buyer will send the Goods. Shipping costs to the collection point are initially borne by the Buyer and will be refunded together with the price of the Goods and the original shipping costs after receipt and inspection of the Goods.

Refunds will be issued within 14 days of receiving and inspecting the returned Goods.

Rights and obligations regarding defective performance are governed by the Civil Code and the Consumer Protection Act.

VIII. WITHDRAWAL FROM THE CONTRACT

Consumers may withdraw from the contract within 14 days of receiving the Goods by sending an e-mail to our contact address.

Withdrawal is not possible for:
a) Goods customized to the Buyer’s specifications,
b) Goods in sealed packaging that have been opened.

The price will be refunded within 14 days of receiving the Goods. The refund will not include non-refundable fees charged by the payment gateway.

Return shipping costs are borne by the Buyer.

IX. FINAL PROVISIONS

Our legal relationship is governed by Czech law.

All communication is conducted electronically (e-mail, User Account).

These Terms may be amended by agreement or unilaterally; changes apply only to new orders.

The Seller is not liable for force majeure events (natural disasters, pandemics, operational outages, subcontractor issues).

If a force majeure event lasts longer than 10 days, both parties have the right to withdraw from the contract.

These Terms come into effect on 28.01.2026.
